These Terms of Service apply when you visit our website, use its features or place an order with KLVN.

By using our website, you agree to these Terms, together with our Privacy Policy, Delivery Information and Returns & Refunds Policy. Nothing in these Terms affects your statutory rights as a consumer.

2. Using our website

You may use this website only for lawful purposes.

You must not:

• Misuse or attempt to interfere with the website.
• Introduce viruses or other harmful technology.
• Attempt to gain unauthorised access to the website or its systems.
• Use the website fraudulently.
• Copy, reproduce or commercially exploit our content without permission.
• Infringe our intellectual property or the rights of another person.

We may restrict or suspend access where we reasonably believe the website is being misused.

3. Product information

We take reasonable care to ensure that our product descriptions, photographs, measurements and prices are accurate.

Colours and appearance may vary slightly depending on screen settings, lighting and the natural characteristics of the garment. Minor variations in colour, finish or placement that do not materially affect the product are not normally considered faults.

Please check the relevant product description and size information before ordering.

Nothing in this section limits your rights where an item is faulty, not as described or otherwise fails to meet the standards required by UK consumer law.

4. Product availability

All products are subject to availability.

Placing an item in your basket does not reserve it. Occasionally, a product may become unavailable after an order has been submitted.

If we cannot fulfil an order, we will contact you and refund any amount paid for the unavailable item.

We may reasonably limit the number of products purchased by one person, household or order, including where we suspect unauthorised resale or fraudulent activity.

5. Orders and contract formation

By placing an order, you are offering to purchase the selected products under these Terms.

You must provide complete and accurate contact, billing and delivery information. Please check your order carefully before submitting it.

After placing an order, you will receive an acknowledgement by email. This confirms that we have received your order but does not necessarily mean that it has been accepted.

A contract between you and KLVN is formed when we confirm that your order has been accepted or dispatched.

We may decline or cancel an order where:

• A product is unavailable.
• The price or product information contains an obvious error.
• Payment cannot be authorised.
• Delivery is unavailable to the address supplied.
• We reasonably suspect fraud, misuse or unauthorised resale.
• We cannot lawfully complete the order.

If payment has already been taken for an order we cannot accept, we will issue a refund.

6. Prices and payment

Prices are displayed in pounds sterling and include applicable UK taxes unless clearly stated otherwise.

Delivery charges are displayed separately before you confirm your order.

We accept the payment methods shown at checkout. Payment must be authorised before an order can be processed.

If a product is accidentally listed at an obviously incorrect price, we may cancel the order and refund the amount paid or contact you to ask whether you wish to proceed at the correct price.

7. Delivery

We deliver to the locations shown at checkout.

Estimated production and delivery times, available delivery services and applicable charges are set out on our Delivery Information page.

Delivery dates are estimates unless we have expressly agreed otherwise. We will contact you if we become aware of a significant delay.

Unless another timeframe has been expressly agreed, goods will be delivered without undue delay and within 30 days of the contract being formed.

We remain responsible for the products until they are delivered to you or to another person you have nominated to receive them. If you independently arrange for a carrier that we did not offer, responsibility may pass when the products are handed to that carrier.

You are responsible for providing a complete and accurate delivery address. Where permitted by law, you may be responsible for reasonable additional costs caused by an incorrect or incomplete address.

8. Cancelling an order

Please contact us as soon as possible at hello@klvnclothing.com if you wish to cancel or amend an order.

We cannot guarantee that an order can be changed or stopped once processing has begun. This does not affect any statutory right to cancel after delivery.

For most products purchased online, UK consumers have the right to cancel without giving a reason. The cancellation period normally expires 14 days after the day on which you, or a person nominated by you, receives the goods.

To exercise this right, you must clearly tell us that you wish to cancel before the cancellation period expires. You may contact us by email or use the model cancellation form at the end of these Terms.

You must return the goods within 14 days after telling us that you wish to cancel.

Exceptions to the statutory cancellation right may apply to products made to your individual specifications or clearly personalised. A product is not automatically excluded from cancellation rights merely because it is produced or fulfilled after an order is placed.

9. Returns and refunds

Returned items should be handled only as much as reasonably necessary to establish their nature, characteristics and fit.

Unless an item is faulty, incorrect or not as described, you may be responsible for the direct cost of returning it.

Where permitted by law, we may make a reasonable deduction from a refund if an item’s value has been reduced because it was handled beyond what was necessary to inspect its nature, characteristics and fit.

Where you exercise your statutory right to cancel the entire order, we will refund the price paid and the cost of our least expensive standard delivery option. Any additional cost paid for premium or expedited delivery will not be refunded beyond the cost of standard delivery.

Refunds will be issued to the original payment method within the legally required period. We may wait until we receive the returned goods or evidence that they have been sent back, whichever happens first.

10. Faulty, damaged or incorrect products

Products must be of satisfactory quality, fit for purpose and as described.

If an item arrives damaged, faulty or incorrect, contact hello@klvnclothing.com with your order number and clear photographs of the issue where reasonably possible.

We may ask you to return the item so that we can assess it.

Where an item is faulty, incorrect or not as described, KLVN will cover reasonable return costs and provide the remedy required by applicable consumer law.

Nothing in these Terms limits your rights under the Consumer Rights Act 2015 or any other applicable consumer legislation.

11. Promotions and discount codes

Promotions and discount codes may be subject to separate conditions, including eligibility requirements, expiry dates and product exclusions.

Unless stated otherwise:

• Only one discount code may be used per order.
• Discount codes cannot be exchanged for cash.
• Discount codes cannot be applied retrospectively.
• Discounts may not apply to delivery charges.
• Promotions may be withdrawn or corrected where there has been an obvious error or misuse.

Your statutory rights are unaffected.

12. Intellectual property

The KLVN name, branding, logos, artwork, garment designs, photographs, videos, text, graphics and website content are owned by or licensed to KLVN Clothing and are protected by applicable intellectual property laws.

You may view and use the website for personal, non-commercial purposes.

You must not copy, reproduce, modify, distribute, sell, publish or commercially use our content without prior written permission.

No licence or ownership right is transferred to you through your use of the website or purchase of a product.

13. Reviews and submitted content

If you submit a review, photograph, comment or other content to KLVN, you confirm that:

• It is truthful and based on your genuine experience.
• You have the right to submit it.
• It does not infringe another person’s rights.
• It is not unlawful, abusive, defamatory or misleading.
• Any incentive or gifted product has been appropriately disclosed.

You grant KLVN Clothing a non-exclusive, worldwide, royalty-free licence to display, reproduce and share that content for the purpose of operating and promoting KLVN.

Where permission has not already been granted, we will request appropriate permission before using customer content obtained from personal social media accounts.

14. Third-party services and Shopify

Our online store is hosted by Shopify, which provides the ecommerce platform used to operate the website.

We may also use third-party providers for services including payments, email marketing, order fulfilment, analytics and delivery.

Your purchase is made directly from Wesley Heard trading as KLVN Clothing, not from Shopify or another technology provider.

Third-party providers may process personal information as explained in our Privacy Policy and their applicable policies.

The website may contain links to third-party websites. We are not responsible for their content, availability or privacy practices.

15. Privacy and cookies

We process personal information in accordance with our Privacy Policy.

Our website uses cookies and similar technologies. Information about the cookies we use and how to control them is available in our Cookie Policy and through the cookie-preference tool on the website.

Where consent is legally required for non-essential cookies or direct marketing, we will request it.

16. Website availability

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend, change or withdraw parts of the website for maintenance, security or operational reasons.

We are not responsible for losses caused solely by events outside our reasonable control. This does not exclude responsibility where doing so would be unlawful.

17. Our liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for:

• Death or personal injury caused by our negligence.
• Fraud or fraudulent misrepresentation.
• Breach of your statutory consumer rights.
• Any other liability that cannot legally be excluded.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Products sold through this website are intended for personal and domestic use. We are not responsible for business losses, including loss of profit, revenue, contracts, opportunity or data, where products are used for commercial purposes.

18. Changes to these Terms

We may update these Terms from time to time to reflect changes to our services, business practices or legal obligations.

The Terms applying to your purchase will normally be those in force when your order is placed. Changes will not retrospectively reduce your statutory or contractual rights.

19. Governing law and disputes

These Terms and any contract between you and KLVN are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you will retain the benefit of any mandatory consumer protections that apply where you live.

The courts of England and Wales will have jurisdiction. Consumers living in Scotland or Northern Ireland may also bring proceedings in their local courts where permitted.
